REVOLUTION IN INHERITED REAL ESTATE

France faces a paradox: millions of vacant homes remain off the market due to legal disputes among heirs. A new law, passed by the National Assembly, aims to change this situation.

📈 INHERITANCE DISPUTES – A CAUSE OF THE HOUSING CRISIS

Over the past 30 years, the number of vacant homes has increased by 60%, reaching 3.1 million properties, which accounts for 8% of the country’s total housing stock. Many of these homes are owned by multiple heirs, but due to disagreements, they cannot be sold, rented, or even renovated.

As a result, many of these properties remain abandoned for decades, leading to their deterioration and even occupation by squatters, creating issues for neighbors.

⚖ THE NEW LAW LOWERS THE THRESHOLD FOR SELLING INHERITED PROPERTY

Previously, under Article 815-5-1 of the Civil Code, selling an inherited property in joint ownership required the consent of heirs holding two-thirds of the shares. Now, this threshold has been lowered to one-half, making the process significantly easier.

For example, if an inherited house belongs to three heirs, and two want to sell while the third refuses, they can now obtain court authorization to proceed with the sale despite the dissenting heir’s objection.

📊 CREATING A DATABASE OF ABANDONED HOMES

The proposed law also includes the creation of a registry of abandoned homes, allowing the government to monitor their condition and prevent further deterioration.

Additionally, the powers of the National Directorate of State Property Management (Dnid) have been expanded. If one of the co-owners has passed away and their heirs cannot be found, and the inheritance process has lasted more than 10 years, the government will now have the authority to sell the property.

Minister of Housing Valérie Létard emphasized: “In the face of the supply crisis, we cannot afford to leave thousands of homes in a state of abandonment!”

The measures adopted will help thousands of families quickly manage their inheritances, and also bring millions of square meters of vacant housing into circulation. Now, it’s up to the Senate – if it approves the law, France will enter a new era in the field of inherited real estate.
